Article L5212-1-1 of the French Public Health Code

Certain medical devices for individual use appearing on a list drawn up by order of the ministers responsible for health and social security may be returned to a state of good repair with a view to re-use by patients other than those who initially used them.

This return to good working order is subject to:

1° Compliance with criteria guaranteeing the quality and safety of use of the medical device returned to good working order;

2° An approval procedure for centres or professionals authorised to return the medical device to good working order.

The terms and conditions for the application of this article are laid down by decree in the Conseil d’Etat, in particular the conditions under which certain medical devices may be returned to a state of good repair and the conditions for carrying out the approval procedure provided for in 2°.

Article L5212-1-1

Certains dispositifs médicaux à usage individuel figurant sur une liste établie par arrêté des ministres chargés de la santé et de la sécurité sociale peuvent faire l’objet d’une remise en bon état d’usage en vue d’une réutilisation par des patients différents de ceux les ayant initialement utilisés.

La réalisation de cette remise en bon état d’usage est subordonnée :

1° Au respect de critères permettant de garantir la qualité et la sécurité sanitaire d’emploi du dispositif médical remis en bon état d’usage ;

2° A une procédure d’homologation des centres ou des professionnels autorisés à réaliser cette remise en bon état d’usage.

Les modalités d’application du présent article sont fixées par décret en Conseil d’Etat, notamment les conditions dans lesquelles certains dispositifs médicaux peuvent faire l’objet d’une remise en bon état d’usage ainsi que les conditions de réalisation de la procédure d’homologation prévue au 2°.
