In order to guarantee compliance with the principle of equal treatment with regard to disabled workers, the employer shall take, depending on the needs in a specific situation, the appropriate measures to enable the workers mentioned in 1° to 4° and 9° to 11° of Article L. 5212-13 to access a job or to keep a job corresponding to their qualification, to carry it out or to progress in it, or so that training adapted to their needs is provided.
The employer shall ensure that the software installed on the workstation of disabled persons and required for their professional activities is accessible. It shall also ensure that the disabled person’s workstation is accessible for teleworking.
These measures are taken on condition that the costs arising from their implementation are not disproportionate, taking into account the assistance provided for in article L. 5213-10 , which may offset all or part of the expenses incurred by the employer in this respect.
Refusal to take measures within the meaning of the first paragraph may constitute discrimination within the meaning of Article L. 1133-3.
