I. – The community of communes whose perimeter is identical to that of a syndicate of communes or a mixed syndicate is substituted ipso jure for that syndicate of communes or that mixed syndicate for all the competences that they exercise.
The community of communes is also substituted ipso jure, for the competences that it exercises or comes to exercise, for the syndicate of communes or the mixed syndicate included entirely within its perimeter.
In the cases provided for in the first and second paragraphs of this article, the substitution of the communauté de communes for the syndicat is carried out under the conditions provided for in the second paragraph of Article L. 5211-41.
II. – The communauté de communes is also substituted, for the competences that it exercises or comes to exercise, for the communes that are members when these are grouped with communes outside the communauté in a syndicat de communes or a syndicat mixte. In the case of a syndicat de communes, the latter becomes a syndicat mixte within the meaning of article L. 5711-1. Neither the remit of the syndicate nor the perimeter within which it exercises its powers are modified.
III. – This article also applies where a public establishment of inter-municipal cooperation merged to form the community of communes was a member of a mixed syndicate.
