From the date of the transfer of competences to the urban community, the latter assumes the debt service of the communes, syndicates of communes included in the conurbation, as well as the obligations of these communities or public establishments in respect of the competences transferred.

The amount of the annual repayments of loans constitutes a compulsory expense for the urban community.

Guarantees granted and subsidies in annual instalments allocated by the départements in favour of the communes or groupings for the construction of works that are the subject of a transfer are carried over to the urban community despite any contractual provisions to the contrary.

A compter de la date du transfert des compétences à la communauté urbaine, celle-ci prend en charge le service de la dette des communes, syndicats de communes compris dans l’agglomération, ainsi que les obligations de ces collectivités ou établissements publics à raison des compétences transférées.

Le montant des annuités de remboursement des emprunts constitue une dépense obligatoire pour la communauté urbaine.

Les garanties accordées et les subventions en annuités attribuées par les départements en faveur des communes ou groupements pour la réalisation d’ouvrages faisant l’objet d’un transfert se trouvent reportées sur la communauté urbaine malgré toutes dispositions conventionnelles contraires.
