By way of derogation from article L. 5211-19, a commune may be authorised, by the State representative in the department after receiving the opinion of the departmental commission for inter-communal cooperation meeting in the formation provided for in the second paragraph of article L. 5211-45, to withdraw from a conurbation community in order to join another public establishment for inter-communal cooperation with its own tax status whose deliberative body has accepted the request for membership. The opinion of the departmental commission for inter-communal cooperation is deemed to be negative if it has not been given within two months.
This withdrawal is carried out under the conditions set out by the departmental commission for inter-communal cooperation.
This withdrawal is carried out under the conditions set out in article L. 5211-25-1 and may not result in the population of the agglomeration community falling below the thresholds mentioned in article L. 5216-1. It is equivalent to a reduction in the perimeter of the mixed syndicates of which the agglomeration community is a member under the conditions set out in the third paragraph of article L. 5211-19.
