Article L5216-9 of the French General Code of Local Authorities

The agglomeration community is dissolved, by decree of the Conseil d’Etat ipso jure when it no longer has more than one member municipality or, at the request of the municipal councils of the member municipalities acquired by a vote of at least two-thirds of the municipal councils of the municipalities concerned representing more than half of the total population of the latter, or of at least half of the municipal councils of the municipalities representing two-thirds of the population, this majority must also necessarily include the municipal council of the municipality whose population is greater than half of the population concerned. This decree determines, in accordance with the provisions of article L. 5211-25-1 and in compliance with the rights of third parties, the conditions under which the agglomeration community is wound up.

The distribution of the staff concerned between the member municipalities may not give rise to a release from management. The staff concerned are appointed to a post at the same level and taking into account their acquired rights. The recipient municipalities bear the corresponding financial costs.

La communauté d’agglomération est dissoute, par décret en Conseil d’Etat de plein droit lorsqu’elle ne compte plus qu’une seule commune membre ou, sur la demande des conseils municipaux des communes membres acquise par un vote des deux tiers au moins des conseils municipaux des communes intéressées représentant plus de la moitié de la population totale de celles-ci, ou de la moitié au moins des conseils municipaux des communes représentant les deux tiers de la population, cette majorité devant en outre nécessairement comprendre le conseil municipal de la commune dont la population est supérieure à la moitié de la population concernée. Ce décret détermine, conformément aux dispositions de l’article L. 5211-25-1 et dans le respect des droits des tiers, les conditions dans lesquelles la communauté d’agglomération est liquidée.

La répartition des personnels concernés entre les communes membres ne peut donner lieu à un dégagement des cadres. Les personnels concernés sont nommés dans un emploi de même niveau et en tenant compte de leurs droits acquis. Les communes attributaires supportent les charges financières correspondantes.
