Article L5217-10-6 of the French General Code of Local Authorities

The appropriations are voted by chapter and, if the Metropolitan Council so decides, by article. In both these cases, the Metropolitan Council may, however, specify that certain appropriations are specialised by article.

In the event of voting by article, the President of the Metropolitan Council may, by express decision, make transfers from article to article within the same chapter excluding articles whose appropriations are specialised.

Within a limit set at the time of the budget vote and which may not exceed 7.5% of the actual expenditure of each of the sections, the Metropolitan Council may delegate to its President the possibility of making transfers of appropriations from chapter to chapter, excluding appropriations relating to staff expenditure. In this case, the President of the Metropolitan Council informs the deliberative assembly of these credit movements at its next meeting.

Les crédits sont votés par chapitre et, si le conseil de la métropole en décide ainsi, par article. Dans ces deux cas, le conseil de la métropole peut cependant spécifier que certains crédits sont spécialisés par article.

En cas de vote par article, le président du conseil de la métropole peut effectuer, par décision expresse, des virements d’article à article à l’intérieur du même chapitre à l’exclusion des articles dont les crédits sont spécialisés.

Dans une limite fixée à l’occasion du vote du budget et ne pouvant dépasser 7,5 % des dépenses réelles de chacune des sections, le conseil de la métropole peut déléguer à son président la possibilité de procéder à des mouvements de crédits de chapitre à chapitre, à l’exclusion des crédits relatifs aux dépenses de personnel. Dans ce cas, le président du conseil de la métropole informe l’assemblée délibérante de ces mouvements de crédits lors de sa plus proche séance.
