Without prejudice to any criminal proceedings that may be brought, where a product or group of products referred to in Article L. 5311-1 is placed on the market, put into service or used without having obtained the prior authorisation, registration or certification required by the legislative or regulatory provisions applicable to this product or group of products, the Agency may suspend, until the product or group of products has been brought into compliance with the laws and regulations in force, the testing, manufacture, preparation, import, use, export, wholesale distribution, packaging, storage, placing on the market free of charge or against payment, holding with a view to sale or free distribution, advertising, putting into service, use, prescription, dispensing or administration of this product or group of products.
Except in emergencies, the natural or legal person concerned must be given the opportunity to present its observations before the suspension measures are taken.
