Article L532-38 of the French Monetary and Financial Code

The Autorité des marchés financiers shall inform the European Securities and Markets Authority without delay of the outcome of the initial authorisation procedure, of any change in the AIFM’s authorisation and of any withdrawal of authorisation.

When informing the European Securities and Markets Authority of applications for authorisation that it has refused, the AMF shall provide details of the AIFM that has applied for authorisation and the reasons for its refusal.

Where the Autorité des marchés financiers has access to the central register of such data maintained by the European Securities and Markets Authority, it shall respect the confidentiality of such data.

L’Autorité des marchés financiers informe sans délai l’Autorité européenne des marchés financiers de l’issue de la procédure d’agrément initiale, de tout changement de l’agrément du gestionnaire et de tout retrait d’agrément.

Lorsqu’elle l’informe des demandes d’agrément qu’elle a refusées, elle lui fournit des données sur le gestionnaire qui a introduit une demande d’agrément et motive son refus.

Lorsque l’Autorité des marchés financiers accède au registre central de ces données tenu par l’Autorité européenne des marchés financiers, elle respecte leur caractère confidentiel.
