Article L532-41 of the French Monetary and Financial Code

Any dispute arising between the Autorité des marchés financiers and the AIFM established in a third country of which France is the reference Member State shall be subject to the jurisdiction of the French courts.

Any dispute between the AIFM established in a third country of which France is the reference Member State and unitholders or shareholders in the European Union of the AIF concerned shall be subject to the jurisdiction of the courts of a Member State.

Tout litige survenant entre l’Autorité des marchés financiers et le gestionnaire établi dans un pays tiers dont la France est l’Etat membre de référence relève de la compétence des juridictions françaises.

Tout litige entre le gestionnaire établi dans un pays tiers dont la France est l’Etat membre de référence et des porteurs de parts ou actionnaires de l’Union européenne du FIA concerné relève de la compétence des juridictions d’un Etat membre.
