Article L533-30-6 of the French Monetary and Financial Code

The fixed portion of the total remuneration of the persons referred to in Article L. 533-30 represents a sufficiently large portion of the total remuneration to allow the greatest possible flexibility with regard to the variable portion of the total remuneration, in particular the possibility of paying none at all.

The ratio of the variable part of the total remuneration to the basic fixed remuneration of the persons mentioned in Article L. 533-30 is subject to a ceiling that it is up to the investment firm to define, taking into account its business activities and the risks associated therewith, as well as the impact that the persons mentioned in this article have on its risk profile.

La part fixe de la rémunération totale des personnes mentionnées à l’article L. 533-30 représente une part de la rémunération totale suffisamment importante pour permettre la plus grande souplesse en ce qui concerne la part variable de la rémunération totale, notamment la possibilité de n’en verser aucune.


Le quotient de la part variable de la rémunération totale rapportée à la rémunération fixe de base des personnes mentionnées à l’article L. 533-30 est soumis à un plafond qu’il appartient à l’entreprise d’investissement de définir, compte tenu de ses activités commerciales et des risques qui y sont associés, ainsi que de l’incidence que les personnes mentionnées à cet article ont sur son profil de risque.
