Article L540-1 of the French Insurance Code

Contracts between insurance undertakings and their tied agents, which do not specify a duration, may always be terminated at the will of one of the contracting parties.

Nevertheless, termination of the contract by one of the contracting parties may give rise to damages which are fixed in accordance witharticle 1780 of the Civil Code.

The parties may not waive in advance any right to claim damages under the above provisions.

Le contrat passé entre les entreprises d’assurance et leurs agents généraux, sans détermination de durée, peut toujours cesser par la volonté d’une des parties contractantes.

Néanmoins, la résiliation du contrat par la volonté d’un seul des contractants peut donner lieu à des dommages-intérêts qui sont fixés conformément à l’article 1780 du code civil.

Les parties ne peuvent renoncer à l’avance au droit éventuel de demander des dommages-intérêts en vertu des dispositions ci-dessus.
