Article L5421-13 of the French Public Health Code

Manufacturing, brokering, distributing, advertising, offering for sale, selling, importing and exporting falsified medicinal products as defined in article L. 5111-3 are punishable by five years’ imprisonment and a fine of €375,000.

The above penalties are increased to seven years’ imprisonment and a fine of €750,000 when :

1° The falsified medicinal product is dangerous to human health ;

2° These same offences have been committed by pharmaceutical establishments authorised in accordance with article L. 5124-3, brokers declared in accordance with article L. 5124-20, dispensing pharmacists holding the licence mentioned in article L. 5125-18 and in-house pharmacists mentioned in article L. 5126-3 of the same code;

3° These same offences were committed as part of an organised gang;

4° The offences of advertising, offering for sale or selling falsified medicinal products were committed on a telecommunications network intended for a non-specified public.

Article L5421-13

La fabrication, le courtage, la distribution, la publicité, l’offre de vente, la vente, l’importation, l’exportation de médicaments falsifiés définis à l’article L. 5111-3 sont punis de cinq ans d’emprisonnement et de 375 000 € d’amende.

Les précédentes peines sont portées à sept ans d’emprisonnement et 750 000 € d’amende lorsque :

1° Le médicament falsifié est dangereux pour la santé de l’homme ;

2° Ces mêmes délits ont été commis par des établissements pharmaceutiques autorisés conformément à l’article L. 5124-3, des courtiers déclarés conformément à l’article L. 5124-20, des pharmaciens d’officine titulaires de la licence mentionnée à l’article L. 5125-18 et des pharmaciens à usage intérieur mentionnés à l’article L. 5126-3 du même code ;

3° Ces mêmes délits ont été commis en bande organisée ;

4° Les délits de publicité, offre de vente ou vente de médicaments falsifiés ont été commis sur un réseau de télécommunication à destination d’un public non déterminé.
