Chapter Ia: Falsified medicinal products

Manufacturing, brokering, distributing, advertising, offering for sale, selling, importing and exporting falsified medicinal products as defined in article L. 5111-3 are punishable by five years’ imprisonment and a fine of €375,000. Anyone found to be in possession of falsified medicinal products without a legitimate reason is liable to three years’ imprisonment and a fine of €75,000. If the falsified medicinal product is dangerous to human health, the penalties are increased to five years’ imprisonment and a fine of €375,000.

Attempts to commit the offences referred to in article L. 5421-13 shall be subject to the same penalties.
