Article L5423-1 of the French Public Health Code

The following is punishable by two years’ imprisonment and a fine of €150,000:

1° Owning or managing a company with at least one pharmaceutical establishment without being a pharmacist or without having appointed a pharmacist as its general manager or manager;

2° Owning or managing an enterprise comprising at least one pharmaceutical establishment and leased to a company that is not owned by a pharmacist or that does not include a pharmacist in its general management or management.

Est puni de deux ans d’emprisonnement et de 150 000 € euros d’amende le fait :

1° D’être propriétaire ou de diriger une entreprise comportant au moins un établissement pharmaceutique sans être pharmacien ou sans avoir désigné un pharmacien à sa direction générale ou à sa gérance ;

2° D’être propriétaire ou de diriger une entreprise comportant au moins un établissement pharmaceutique et concédée en location gérance à une société qui n’est pas la propriété d’un pharmacien ou qui ne comporte pas la participation d’un pharmacien à sa direction générale ou à sa gérance.
