Article L5511-3 of the French Public Health Code

Article L. 5125-4, applicable in Mayotte, reads as follows:

“Art. L. 5125-4. – In municipalities with a population of 15,000 or more, only one licence may be issued for each whole block of 7,000 inhabitants counted.

In municipalities with a population of less than 15,000, only one licence may be issued for each whole block of 7,000 inhabitants counted in the health democracy territory to which the municipality belongs. A decree determines the territories of health democracy.

When the creation of a pharmacy can be authorised in application of the previous paragraph, the State representative, with a view to ensuring that the population is adequately served, may designate the municipality in which the pharmacy is to be located.

The number of inhabitants taken into account for the application of this article is the municipal population as established by the most recent population census published in the Journal Officiel. “

L’article L. 5125-4, applicable à Mayotte, est ainsi rédigé :

” Art. L. 5125-4. – Dans les communes d’une population égale ou supérieure à 15 000 habitants, il ne peut être délivré qu’une licence par tranche entière de 7 000 habitants recensés.

Dans les communes d’une population inférieure à 15 000 habitants, il ne peut être délivré qu’une licence par tranche entière de 7 000 habitants recensés dans le territoire de démocratie sanitaire auquel appartient la commune. Un décret détermine les territoires de démocratie sanitaire.

Lorsque la création d’une officine peut être autorisée en application de l’alinéa précédent, le représentant de l’Etat, en vue d’assurer une desserte satisfaisante de la population, peut désigner la commune dans laquelle l’officine doit être située.

Le nombre d’habitants dont il est tenu compte pour l’application du présent article est la population municipale telle qu’elle est établie par le dernier recensement de la population publié au Journal officiel. ”
