Article L552-15 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When accommodation is terminated in accordance with the conditions laid down in articles L. 551-11 to L. 551-14, the competent administrative authority or the manager of the accommodation may apply to the courts, after unsuccessful formal notice, for the unauthorised occupant to be ordered to vacate the premises.

The first paragraph does not apply to persons who have been recognised as refugees or who have been granted subsidiary protection.

The request is made to the president of the local authority.
The application is brought before the president of the administrative court, who rules on the basis of article L. 521-3 of the administrative justice code and whose order is immediately enforceable.

Lorsqu’il est mis fin à l’hébergement dans les conditions prévues aux articles L. 551-11 à L. 551-14, l’autorité administrative compétente ou le gestionnaire du lieu d’hébergement peut demander en justice, après mise en demeure restée infructueuse, qu’il soit enjoint à cet occupant sans titre d’évacuer ce lieu.


Le premier alinéa n’est pas applicable aux personnes qui se sont vues reconnaître la qualité de réfugié ou qui ont obtenu le bénéfice de la protection subsidiaire. Il est en revanche applicable aux personnes qui ont un comportement violent ou commettent des manquements graves au règlement du lieu d’hébergement.


La demande est portée devant le président du tribunal administratif, qui statue sur le fondement de l’article L. 521-3 du code de justice administrative et dont l’ordonnance est immédiatement exécutoire.
