Article L561-41 of the French Monetary and Financial Code

I. – The Commission Nationale des Sanctions (National Enforcement Committee) receives reports or procedures drawn up following inspections carried out by the administrative authorities referred to in Article L. 561-36-2.

II. – The Secretary General of the Commission notifies the respondent of the objections likely to be upheld by the Commission. When the complaints are notified to a legal entity, they are also notified to its legal representatives and, in the case of the persons mentioned in 9° and 9° bis of Article L. 561-2, also to the directors responsible.

Where applicable, these complaints are also notified to the central body to which the person in question is affiliated or linked and brought to the attention of the professional association to which it belongs.

In exercising these powers, the Secretary General of the Commission may not receive any instructions.

Article L561-41

I. – La Commission nationale des sanctions reçoit les rapports ou les procédures établis à la suite des contrôles effectués par les autorités administratives mentionnées à l’article L. 561-36-2.

II. – Le secrétaire général de la commission notifie les griefs susceptibles d’être retenus par la commission à la personne mise en cause. Lorsque les griefs sont notifiés à une personne morale, ils sont également notifiés à ses représentants légaux et, s’agissant des personnes mentionnées aux 9° et 9° bis de l’article L. 561-2, également à ses directeurs responsables.

Le cas échéant, ces griefs sont également notifiés à l’organisme central auquel est affiliée ou liée la personne en cause et portés à la connaissance de l’association professionnelle à laquelle elle adhère

Dans l’exercice de ces attributions, le secrétaire général de la commission ne peut recevoir aucune instruction.
