Article L562-4 of the French Monetary and Financial Code

The following are required to apply without delay the freezing measures and prohibitions on making available or using the assets provided for in this chapter and in Articles L. 712-4 and L. 712-10 and to immediately inform the Minister responsible for the economy thereof:

1° Any natural person, whether a national or a foreign national, who is on national territory ;

2° The persons referred to in Article L. 561-2 and any other legal entity constituted or established under national law or carrying out an operation on national territory as part of its business, in particular :

a) Persons whose registered office is located on national territory for their activities carried out abroad, including in branches or any other form of free establishment as well as under the freedom to provide services ;

b) Persons whose registered office is located outside France for their activities carried out in France, including through branches or any other form of free establishment and under the freedom to provide services;

c) Legal entities governed by public law, bodies responsible for the management of a public service and funds and bodies responsible for the management of a social protection scheme.

A Conseil d’Etat decree specifies the conditions for application of this article.

Article L562-4

Sont tenus d’appliquer sans délai les mesures de gel et les interdictions de mise à disposition ou d’utilisation prévues au présent chapitre et aux articles L. 712-4 et L. 712-10 et d’en informer immédiatement le ministre chargé de l’économie :

1° Toute personne physique, ressortissante nationale ou ressortissante étrangère se trouvant sur le territoire national ;

2° Les personnes mentionnées à l’article L. 561-2 ainsi que toute autre personne morale constituée ou établie selon le droit national ou réalisant une opération sur le territoire national, dans le cadre de son activité, en particulier :

a) Les personnes dont le siège social est situé sur le territoire national pour leurs activités réalisées à l’étranger, y compris dans les succursales ou toute autre forme de libre établissement ainsi qu’en libre prestation de services ;

b) Les personnes dont le siège social est situé hors du territoire national pour leurs activités réalisées en France, y compris dans les succursales ou toute autre forme de libre établissement ainsi qu’en libre prestation de services ;

c) Les personnes morales de droit public, les organismes chargés de la gestion d’un service public ainsi que les caisses et les organismes chargés de la gestion d’un régime de protection sociale.

Un décret en Conseil d’Etat précise les conditions d’application du présent article.
