Article L5731-1 of the French General Code of Local Authorities

The metropolitan cluster is a public establishment set up by agreement between public establishments for intercommunal cooperation with their own tax status and, where applicable, the Lyon metropolis, with a view to actions of metropolitan interest, in order to promote a model of planning, sustainable development and territorial solidarity.

By way of derogation from the first paragraph of this article, a new commune mentioned in the first and second paragraphs of article L. 2113-9 may join a metropolitan cluster. In this case, for the application of this chapter, the municipal council of the new commune shall exercise the powers recognised to the deliberative body of the public inter-municipal cooperation establishment that is a member of the cluster.

The deliberative bodies of the public establishments of inter-municipal cooperation and, where applicable, the regional councils, the departmental councils and the council of the Lyon metropolitan authority that are members of the metropolitan cluster shall decide, through concordant deliberations, on the metropolitan interest of the competences that they transfer or the actions that they delegate to the metropolitan cluster.

Article L5731-1

Le pôle métropolitain est un établissement public constitué par accord entre des établissements publics de coopération intercommunale à fiscalité propre ainsi que, le cas échéant, la métropole de Lyon, en vue d’actions d’intérêt métropolitain, afin de promouvoir un modèle d’aménagement, de développement durable et de solidarité territoriale.

Par dérogation au premier alinéa du présent article, une commune nouvelle mentionnée aux premier et deuxième alinéas de l’article L. 2113-9 peut adhérer à un pôle métropolitain. Dans ce cas, pour l’application du présent chapitre, le conseil municipal de la commune nouvelle exerce les compétences reconnues à l’organe délibérant de l’établissement public de coopération intercommunale membre du pôle.

Les organes délibérants des établissements publics de coopération intercommunale ainsi que, le cas échéant, les conseils régionaux, les conseils départementaux et le conseil de la métropole de Lyon membres du pôle métropolitain se prononcent, par délibérations concordantes, sur l’intérêt métropolitain des compétences qu’ils transfèrent ou des actions qu’ils délèguent au pôle métropolitain.
