Article L5842-30 of the French General Code of Local Authorities

I. – Articles L. 5216-9 and L. 5216-10 are applicable in French Polynesia subject to the adaptations provided for in II.

II. – For the application of Article L. 5216-10:

1° In the first paragraph the words: “the publication of law no. 99-586 of 12 July 1999 relating to the strengthening and simplification of inter-communal cooperation, the perimeter of the agglomeration communities” are replaced by the words: “the date of creation of an agglomeration community, its perimeter”;

2° The second sentence of the first paragraph is deleted;

3° In the second paragraph, the words: “when the communes are part of the same department, or by joint order of the representatives of the State in the departments concerned when the projected perimeter extends beyond a single department,” are deleted.

Article L5842-30

I. – Les articles L. 5216-9 et L. 5216-10 sont applicables en Polynésie française sous réserve des adaptations prévues au II.

II. – Pour l’application de l’article L. 5216-10 :

1° Au premier alinéa les mots : ” la publication de la loi n° 99-586 du 12 juillet 1999 relative au renforcement et à la simplification de la coopération intercommunale, le périmètre des communautés d’agglomération ” sont remplacés par les mots : ” la date de création d’une communauté d’agglomération, son périmètre ” ;

2° La deuxième phrase du premier alinéa est supprimée ;

3° Au deuxième alinéa, les mots : ” lorsque les communes font partie du même département, ou par arrêté conjoint des représentants de l’Etat dans les départements concernés lorsque le périmètre projeté s’étend au-delà d’un seul département, ” sont supprimés.
