For the purposes of this Title, the following definitions shall apply:
1° National dispute: a dispute of a contractual nature between a consumer and a seller or supplier concerning the performance of a contract of sale or provision of services, where, at the time the contract was concluded, the consumer resides in the same Member State as that in which the seller or supplier is established;
2° Cross-border dispute: a dispute of a contractual nature between a consumer and a seller or supplier concerning the performance of a contract of sale or provision of services, where, at the time the contract was concluded, the consumer resides in a Member State other than that in which the seller or supplier is established: a dispute of a contractual nature between a consumer and a trader relating to the performance of a sales or service contract, where at the time of its conclusion the consumer resides in a Member State other than that of the trader’s place of establishment;
3° Sales contract: any contract within the meaning of Article 1582 of the Civil Code, as well as any contract having as its object both the sale of a good and the provision of a service, concluded between a professional and a consumer;
4° Contract for the provision of services: any contract having as its object the provision of a service by the professional in return for which the consumer undertakes to pay the price;
5° Mediation of consumer disputes: a conventional mediation process, as defined in the article 21 de la loi n° 95-125 du 8 février 1995 relative à l’organisation des juridictions et de la procédure civile, pénale et administrative ou un autre processus de médiation conventionnelle prévu par la loi;
6° Médiateur de la consommation : the natural person or legal entity carrying out a conventional mediation mission;
7° Public Mediator: a mediator appointed by a public authority under the conditions laid down by law, which also determines his status, his field of competence in the area of disputes provided for in this Title and his methods of intervention.
