The following may not be subject to a decision imposing an obligation to leave French territory:
1° Foreign nationals under the age of eighteen;
2° Foreign nationals who can prove by any means whatsoever that they have been ordinarily resident in France since reaching the age of thirteen;

3° Foreign nationals who have been legally resident in France for more than ten years, unless they have held a temporary or multi-annual residence permit bearing the word “student” throughout this period;
> 4° Foreign nationals who have been legally resident in France for more than ten years, unless they have held a temporary or multi-annual residence permit bearing the word “student” throughout this period;
4° A foreign national who has been legally resident in France for more than twenty years;
5° A foreign national who is the father or mother of a minor French child residing in France, provided that he/she can prove that he/she is effectively contributing to the child’s maintenance and education under the conditions set out in the article 371-2 of the Civil Code since the birth of the child or for at least two years;
6° A foreign national who has been married for at least three years to a spouse of French nationality, provided that the community of life has not ceased since the marriage and that the spouse has retained French nationality;
7° A foreign national who has been legally resident in France for more than ten years and who has been married for at least three years to a foreign national covered by 2°, provided that the community of life has not ceased since the marriage;
8° A foreign national receiving a pension for an accident at work or occupational disease from a French organisation and whose permanent incapacity rate is equal to or greater than 20%;
9° Foreign nationals ordinarily resident in France if their state of health requires medical care, the lack of which could have exceptionally serious consequences for them and if, in view of the supply of healthcare and the characteristics of the healthcare system in the country of return, they could not effectively benefit from appropriate treatment there.
By way of derogation from the present article, the foreign national mentioned in 2° to 8° may be subject to a decision imposing an obligation to leave French territory pursuant to article L. 611-1 if he or she is living in France in a state of polygamy.
