Article L611-8 of the French Intellectual Property Code

If an industrial property title has been applied for either for an invention taken from the inventor or his successors in title, or in breach of a legal or contractual obligation, the injured party may claim ownership of the application or the title issued.

The claim action is barred after five years from the publication of the issue of the industrial property title.

However, in the event of bad faith at the time the title was issued or acquired, the limitation period shall be five years from the expiry of the title.

Si un titre de propriété industrielle a été demandé soit pour une invention soustraite à l’inventeur ou à ses ayants cause, soit en violation d’une obligation légale ou conventionnelle, la personne lésée peut revendiquer la propriété de la demande ou du titre délivré.

L’action en revendication se prescrit par cinq ans à compter de la publication de la délivrance du titre de propriété industrielle.

Toutefois, en cas de mauvaise foi au moment de la délivrance ou de l’acquisition du titre, le délai de prescription est de cinq ans à compter de l’expiration du titre.
