I.-Local hospitals, or the health establishment to which they belong when they do not have legal personality, organise cooperation with primary care providers in the areas they serve and, to this end, conclude an agreement with their partners within one year of their inclusion on the regional list referred to in article L. 6111-3-1, an agreement with their partners.
The parties to this agreement may be establishments, one or more territorial professional health communities or other healthcare players covered by this code or local authorities, depending on the healthcare provision and healthcare needs of the territories they serve.
II.This agreement defines the scope of cooperation, particularly in terms of access to care, the availability of care and the organisation of healthcare pathways, as well as the procedures for sharing information between the parties and organising this cooperation. It specifies the cooperative ventures established between the parties, as well as those they undertake to enter into in order to carry out the tasks set out in article L. 6111-3-1.
The agreement sets out the procedures for monitoring and evaluating the partners’ commitments and projects. To this end, it defines the body responsible for monitoring and evaluating the implementation of cooperative ventures, which may be one of the following bodies:
1° The local hospital’s institutional medical committee referred to in articles L. 6144-1 and L. 6161-2-1 or the local hospital’s medical conference referred to in article L. 6161-2. The composition of this body may be adapted, if necessary, in application of article L. 6111-3-4;
2° The governance body of one of the territorial professional health communities that is a party to the agreement;
3° A governance body of a local health contract for the territory;
4° A specific governance body created by the agreement.
III. -The agreement is sent to the relevant regional health agency by the local hospital or the health establishment in the grouping to which they belong when they do not have legal personality. It shall be accompanied by a document specifying the changes to the organisation and operation of the local hospital required as a result of the planned cooperation.
The regional health agency shall ensure that the commitments made in the agreement are effectively implemented, in line with the territorial health projects and, where applicable, the health projects of the territorial professional health communities and the local health contracts.
