An agreement is signed between the public entity mentioned in the last paragraph of article L. 6113-11 and each health care organisation on the list mentioned in article L. 6113-12.
If a health care organisation refuses to sign this agreement, the Director General of the Regional Health Agency, after the organisation has been given the opportunity to present its observations, shall impose a financial penalty, the amount of which may not exceed 1% of the income received by the health care organisation from compulsory health insurance schemes in respect of the last financial year for which the accounts have been closed. This penalty is paid to the health insurance scheme.
In return for the resources committed by the institution to produce the data required to carry out national cost studies, the public entity mentioned in the last paragraph of article L. 6113-11 provides this institution with funding under the conditions defined by the agreement.
In the event of non-compliance with its contractual obligations, the institution shall reimburse the compensation received, under the conditions defined by the agreement.
