Article L6113-13 of the French Public Health Code

An agreement is signed between the public entity mentioned in the last paragraph of article L. 6113-11 and each health care organisation on the list mentioned in article L. 6113-12.

If a health care organisation refuses to sign this agreement, the Director General of the Regional Health Agency, after the organisation has been given the opportunity to present its observations, shall impose a financial penalty, the amount of which may not exceed 1% of the income received by the health care organisation from compulsory health insurance schemes in respect of the last financial year for which the accounts have been closed. This penalty is paid to the health insurance scheme.

In return for the resources committed by the institution to produce the data required to carry out national cost studies, the public entity mentioned in the last paragraph of article L. 6113-11 provides this institution with funding under the conditions defined by the agreement.

In the event of non-compliance with its contractual obligations, the institution shall reimburse the compensation received, under the conditions defined by the agreement.

Article L6113-13

Une convention est signée entre la personne publique mentionnée au dernier alinéa de l’article L. 6113-11 et chaque établissement de santé figurant sur la liste mentionnée à l’article L. 6113-12.

En cas de refus d’un établissement de santé de signer cette convention, le directeur général de l’agence régionale de santé prononce, après que l’établissement a été mis en mesure de présenter ses observations, une pénalité financière, dont le montant ne peut excéder 1 % des produits reçus des régimes obligatoires d’assurance maladie par l’établissement de santé au titre du dernier exercice clos. Cette pénalité est versée à l’assurance maladie.

En contrepartie des moyens engagés par l’établissement pour produire les données nécessaires à la réalisation des études nationales de coûts, la personne publique mentionnée au dernier alinéa de l’article L. 6113-11 assure à cet établissement un financement dans les conditions définies par la convention.

En cas de non-respect de ses obligations contractuelles, l’établissement restitue les indemnités perçues, dans les conditions définies par la convention.
