The Secretary General of the Autorité de contrôle prudentiel et de résolution may decide to extend the on-site supervision of a person subject to its supervision:
1° To its subsidiaries ;
2° To legal entities that directly or indirectly control it within the meaning ofArticle L. 233-3 of the Commercial Code;
3° Subsidiaries of these legal entities;
4° Any other company or legal entity belonging to the same group;
5° Persons and organisations of any kind which have entered, directly or indirectly, into a management, reinsurance or any other type of agreement with this company which is likely to affect its operational or decision-making autonomy in any of its areas of activity;
6° Undertakings which are linked within the meaning of 4° of Article L. 356-1 of the Insurance Code to the parent undertakings mentioned in 1° of the same Article;
7° Mutual insurers and unions governed by Book III of the Mutual Code which are affiliated to it;
8° Institutions for the management of supplementary pensions with which it has links;
9° Employees and persons entrusted with operational functions or activities.
The Secretary General may inform the person referred to in the first paragraph of this article of the facts gathered during this extension of the inspection, without prejudice to the professional secrecy referred to in Article L. 612-17 .
On-site inspections may also be extended to branches or subsidiaries located abroad of undertakings subject to supervision by the AMF either, in the case of inspections in a State party to the Agreement on the European Economic Area, pursuant to Article L. 632-12 or, in the case of other States, under the bilateral agreements provided for in Article L. 632-13 or with the express agreement of the competent authority responsible for a task similar to that entrusted, in France, to the Autorité de contrôle prudentiel et de résolution, provided that this authority is itself subject to professional secrecy. For countries with which one of the bilateral agreements provided for in the same Article L. 632-13 has not been concluded, the Secretary General is responsible for obtaining the agreement of the competent authority concerned and specifying with it, if necessary, the conditions for extending on-site supervision of a given reporting entity to its subsidiaries or branches. These conditions are brought to the attention of this person and these entities.
