Article L612-25 of the French Monetary and Financial Code

In the event of failure to comply with an obligation to notify, declare or transmit statements, documents, data or hearings requested by the Secretary General or one of the panels of the Autorité, the Autorité de contrôle prudentiel et de résolution may issue an injunction accompanied by a penalty payment, the amount and effective date of which it shall determine.

The penalty shall be recovered by the public accountant and paid into the State budget.

A decree in the Conseil d’Etat shall set the conditions for application of this article, and in particular the maximum daily amount and the procedures for liquidation of the penalty payment in the event of total or partial non-performance or late performance.

Article L612-25

En cas de méconnaissance d’une obligation de notification, de déclaration ou de transmission d’états, de documents, de données ou d’audition demandés par le secrétaire général ou une des formations de l’Autorité, l’Autorité de contrôle prudentiel et de résolution peut prononcer une injonction assortie d’une astreinte dont elle fixe le montant et la date d’effet.

L’astreinte est recouvrée par le comptable public et versée au budget de l’Etat.

Un décret en Conseil d’Etat fixe les conditions d’application du présent article, et notamment le montant journalier maximum et les modalités de liquidation de l’astreinte en cas d’inexécution totale ou partielle ou de retard d’exécution.
