Article L613-70 of the French Monetary and Financial Code

The authorisation provided for in Article 18(3) of Commission Regulation (EU) No 1031/2010 of 12 November 2010 on the timing, management and other aspects of the auctioning of greenhouse gas emission allowances shall be issued to credit institutions and investment firms by the Autorité de contrôle prudentiel et de résolution, after obtaining the opinion of the Autorité des marchés financiers. The opinion of the Autorité des marchés financiers relates to the conditions mentioned in a, b and d of paragraph 5 of article 59 of the aforementioned regulation. The authorisation is withdrawn in accordance with the same procedure, without prejudice to the penalties provided for in articles L. 612-39 and L. 612-40.

Article L613-70

L’autorisation prévue au 3 de l’article 18 du règlement (UE) n° 1031/2010 de la Commission européenne du 12 novembre 2010 relatif au calendrier, à la gestion et aux autres aspects de la mise aux enchères des quotas d’émission de gaz à effet de serre est délivrée aux établissements de crédit et aux entreprises d’investissement par l’Autorité de contrôle prudentiel et de résolution, après avis de l’Autorité des marchés financiers. L’avis de cette dernière porte sur les conditions mentionnées aux a, b et d du paragraphe 5 de l’article 59 du règlement précité. L’autorisation est retirée selon la même procédure, sans préjudice des sanctions prévues aux articles L. 612-39 et L. 612-40.
