For the purposes referred to in Article L. 6131-1, the Director General of the Regional Health Agency may ask public health establishments:
1° To enter into a cooperation agreement ;
2° To set up a health cooperation group, a public interest group or an inter-hospital medical federation as provided for in Article L. 6135-1 ;
3° To take a decision to merge the establishments concerned under the conditions set out in article L. 6141-7-1.
The Chief Executive Officer sends his request to the Supervisory Board, the Management Board and the Medical Committee of the establishments concerned, giving full details of the economic and social consequences and the operation of the new organisation of care.
If the request is not acted upon, the Director General of the Regional Health Agency may, after consultation with the supervisory boards of the establishments concerned, take appropriate measures, in particular a reduction in the funding allocations referred to in article L. 162-22-13 of the Social Security Code, so that, depending on the case, the establishments enter into a cooperation agreement, create a public interest group, a health cooperation group or an inter-hospital medical federation. In the latter case, the Director General of the Regional Health Agency sets the competences that must be transferred to the grouping from a list drawn up by decree in the Conseil d’Etat.
