Article L6142-7 of the French Public Health Code

As stated in I of article L. 713-4 of the Education Code, which reads as follows:

” I.-Notwithstanding articles L. 712-2, L. 712-3 and L. 712-6-1, the medical, pharmacy, odontology and midwifery training and research units or, failing that, the components providing these training courses shall enter into agreements with the regional hospital centres, in accordance with articles L. 713-5 and L. 713-6, and, where applicable, with cancer centres and private not-for-profit health establishments, in accordance witharticle L. 6142-5 of the Public Health Code, the purpose of which is to determine the structure and operating procedures of the hospital and university centre. These agreements must comply with the university’s strategic guidelines as defined in the multi-annual establishment contract, particularly in the field of research involving the human person.

The director of the unit or component is authorised to sign these agreements on behalf of the university.

These agreements may only be executed after they have been approved by the President of the University and voted by the University’s Administrative Board.

The president of the university may delegate his signature to the director to authorise the income and expenditure of the training and research unit or component.

Teaching and hospital staff jobs in university hospitals are allocated in accordance with the provisions of article L. 952-21.

The revision of teaching and hospital staff numbers takes into account public health needs, on the one hand, and teaching and research needs, on the other. “

Article L6142-7

Comme il est dit au I de l’article L. 713-4 du code de l’éducation, ainsi reproduit :

” I.-Par dérogation aux articles L. 712-2, L. 712-3 et L. 712-6-1, les unités de formation et de recherche de médecine, de pharmacie, d’odontologie et de maïeutique ou, à défaut, les composantes qui assurent ces formations concluent, conjointement avec les centres hospitaliers régionaux, conformément aux articles L. 713-5 et L. 713-6, et, le cas échéant, avec les centres de lutte contre le cancer et les établissements de santé privés à but non lucratif, conformément à l’article L. 6142-5 du code de la santé publique, les conventions qui ont pour objet de déterminer la structure et les modalités de fonctionnement du centre hospitalier et universitaire. Elles respectent les orientations stratégiques de l’université définies dans le contrat pluriannuel d’établissement, notamment dans le domaine de la recherche impliquant la personne humaine.

Le directeur de l’unité ou de la composante a qualité pour signer ces conventions au nom de l’université.

Ces conventions ne peuvent être exécutées qu’après avoir été approuvées par le président de l’université et votées par le conseil d’administration de l’université.

Le président de l’université peut déléguer sa signature au directeur pour ordonnancer les recettes et les dépenses de l’unité de formation et de recherche ou de la composante.

Les emplois du personnel enseignant et hospitalier des centres hospitaliers et universitaires sont affectés dans le respect des dispositions de l’article L. 952-21.

La révision des effectifs enseignants et hospitaliers prend en compte les besoins de santé publique, d’une part, et d’enseignement et de recherche, d’autre part. “
