When the sums due in respect of default interest and the fixed indemnity for recovery costs mentioned in Articles 39 and 40 of Law 2013-100 of 28 January 2013 containing various provisions for adapting legislation to European Union law in economic and financial matters are not mandated within thirty days of the date of payment of the principal, the Director of the Regional Health Agency shall send the authorising officer formal notice to pay within fifteen days of notification by the creditor, the public accountant or any other third party. If the expenditure is not paid within one month of this formal notice, the director of the regional health agency will automatically pay the expenditure within ten days.
However, if, within the period of one month available to him for mandating the sums due in respect of default interest and the fixed indemnity for recovery costs, the authorising officer notifies a refusal to execute on the grounds of insufficient available appropriations, the director of the regional health agency, within fifteen days of this notification, establishes this insufficiency and gives formal notice to the establishment to take a decision amending the statement of estimates of revenue and expenditure. If the director of the institution fails to do so, the director of the regional health agency will amend the statement of estimated income and expenditure and then automatically authorise payment.
