I. – The Ministry of Defence shall enter into a specific five-year contract with the Regional Health Agency in the following cases:
1° An armed forces hospital is established within the remit of the Regional Health Agency concerned;
2° One or more other elements of the armed forces health service mentioned in articles L. 1222-11, L. 5124-8 or L. 6326-1 contribute to the regional health project;
3° One or more elements of the armed forces health service other than those mentioned in 1° and 2° contribute to the regional health project;
4° Specific defence needs are included in the regional health plan provided for in article L. 1434-2;
II. – This contract, which sets out at regional level the protocol provided for in article L. 6147-11, defines in particular the cooperation actions of the armed forces health service to meet the health needs of the region and the specific needs of defence.
After agreement from the Minister of Defence, amendments to this contract may be signed between the regional health agency and the armed forces hospitals and, where applicable, the other elements of the armed forces health service mentioned in articles L. 1222-11, L. 5124-8 and L. 6326-1.
III. – The specific contract provided for in I specifies, where applicable, the specific needs of defence identified by the plan mentioned in article L. 1434-3. These needs are in addition to the authorisation conditions listed in article L. 6122-2.
IV. – The contract provided for in I and its amendments provide for financial compensation for the commitments made by the armed forces hospitals and other elements of the armed forces health service to meet the health needs of the region.
