Article L621-1 of the French Intellectual Property Code

The penalties for violating trade secrets are set out in Article L. 1227-1 of the Labour Code, reproduced below:

“Art. L. 1227-1- The fact of a director or an employee revealing or attempting to reveal a manufacturing secret is punishable by two years’ imprisonment and a fine of 30,000 euros.

The court may also impose, as an additional penalty, for a period of up to five years, the disqualification from civic, civil and family rights provided for by Article 131-26 of the Penal Code. “

Les peines frappant la violation des secrets de fabrique sont prévues à l’article L. 1227-1 du code du travail ci-après reproduit :

” Art. L. 1227-1- Le fait pour un directeur ou un salarié de révéler ou de tenter de révéler un secret de fabrication est puni d’un emprisonnement de deux ans et d’une amende de 30 000 euros.

La juridiction peut également prononcer, à titre de peine complémentaire, pour une durée de cinq ans au plus, l’interdiction des droits civiques, civils et de famille prévue par l’article 131-26 du code pénal. “
