Without prejudice to Article 40 of the Code of Criminal Procedure, Articles L. 621-17-3 and L. 621-20-1 of this Code and the exercise of its powers by the Autorité des marchés financiers, the latter, as well as each of its members, experts appointed to the consultative commissions mentioned in III of Article L. 621-2, members of its staff and officers, from disclosing information gathered pursuant to Article 16 of Regulation (EU) No 596/2014 of the European Parliament and of the Council of 16 April 2014 on market abuse (Market Abuse Regulation) and repealing Directive 2003/6/EC of the European Parliament and of the Council and Commission Directives 2003/124/EC, 2003/125/EC and 2004/72/EC. If the Autorité des marchés financiers uses the assistance of the persons mentioned in Article L. 621-9-2, this prohibition also applies to these persons, as well as to their managers and agents.
Any member of the Autorité des marchés financiers, expert appointed to the consultative commissions referred to in III of Article L. 621-2, member of its staff or agent who discloses the content of the report or the identity of the persons concerned shall be liable to the penalties provided for in Article L. 642-1. If the Autorité des marchés financiers uses the assistance of the persons referred to in Article L. 621-9-2, these penalties shall also apply to these persons, as well as to their managers and agents.
If the transactions covered by the report fall within the jurisdiction of a competent authority in another Member State of the European Union or party to the Agreement on the European Economic Area, the AMF shall forward the report to that authority without delay, along with any additional information provided by the reporting firm at the request of the authority, in accordance with the conditions laid down in Article L. 632-16.
