Article L621-6 of the French Code governing the entry and residence of foreign nationals and the right of asylum

A decision to surrender to the competent authorities of a Member State of the European Union may be issued to a foreign national and his or her family members, admitted to reside in the territory of that State and carrying out an intra-group temporary posting in accordance with Directive 2014/66/EU of the European Parliament and of the Council of 15 May 2014 on the conditions of entry and residence of third-country nationals in the context of an intra-group temporary transfer, where that foreign national is in one of the following situations:
1° The residence permit has expired or has been withdrawn by the State which issued it, during the period of mobility;
2° The administrative authority has not received notification of the foreign national’s intention to work in one of the establishments of his or her original group of companies located on French territory;
3° The administrative authority has objected to the mobility of this foreign national for a period of less than or equal to ninety days;
4° The administrative authority has rejected a request from this foreign national for mobility for a period of more than ninety days;
5° The conditions for issuing the residence permit have not been met;
6° The conditions under which the mobility of this foreign national between two States mentioned in Article L. 621-1 were authorised are no longer met.

Article L621-6

Peuvent faire l’objet d’une décision de remise aux autorités compétentes d’un Etat membre de l’Union européenne l’étranger et les membres de sa famille, admis à séjourner sur le territoire de cet Etat et effectuant un détachement temporaire intragroupe conformément à la directive 2014/66/UE du Parlement européen et du Conseil du 15 mai 2014 établissant les conditions d’entrée et de séjour des ressortissants de pays tiers dans le cadre d’un transfert temporaire intragroupe, lorsque cet étranger se trouve dans l’une des situations suivantes :
1° Le titre de séjour a expiré ou a été retiré par l’État qui l’a délivré, au cours de la période de mobilité ;
2° L’autorité administrative n’a pas reçu la notification de l’intention de cet étranger de travailler dans l’un des établissements de son groupe d’entreprises d’origine implanté sur le territoire français ;
3° L’autorité administrative a fait objection à la mobilité d’une durée inférieure ou égale à quatre-vingt-dix jours de cet étranger ;
4° L’autorité administrative a rejeté une demande de mobilité d’une durée supérieure à quatre-vingt-dix jours de cet étranger ;
5° Les conditions de délivrance du titre de séjour n’ont pas été respectées ;
6° Les conditions auxquelles la mobilité de cet étranger entre deux États mentionnés à l’article L. 621-1 a été autorisée ne sont plus réunies.
