Article L623-32 of the French Intellectual Property Code

Any infringement knowingly committed against the rights of the holder of a plant variety certificate, as defined in Article L. 623-4, constitutes an offence punishable by a fine of 10,000 euros. If the accused has been convicted of the same offence within the previous five years, or if the offence is committed as part of an organised gang or on an online public communication network, he or she may also be sentenced to six months’ imprisonment.

Toute atteinte portée sciemment aux droits du titulaire d’un certificat d’obtention végétale, tels qu’ils sont définis à l’article L. 623-4, constitue un délit puni d’une amende de 10 000 euros. Lorsqu’il a été rendu contre le prévenu dans les cinq années antérieures une condamnation pour le même délit ou en cas de commission du délit en bande organisée ou sur un réseau de communication au public en ligne, un emprisonnement de six mois peut, en outre, être prononcé.
