Article L623-33 of the French Intellectual Property Code

Public proceedings for the application of the penalties provided for in the preceding article may only be brought by the Public Prosecutor’s Office on a complaint from the injured party.

The criminal court hearing the case may only rule after the civil court has established the reality of the offence by a decision that has become res judicata. Objections raised by the defendant to the nullity of the plant variety certificate or questions relating to the ownership of the said certificate may only be raised before the civil court.

L’action publique pour l’application des peines prévues au précédent article ne peut être exercée par le ministère public que sur plainte de la partie lésée.

Le tribunal correctionnel saisi ne peut statuer qu’après que la juridiction civile a constaté la réalité du délit par une décision passée en force de chose jugée. Les exceptions tirées par le défenseur de nullité du certificat d’obtention ou des questions relatives à la propriété dudit certificat ne peuvent être soulevées que devant la juridiction civile.
