Article L623-9 of the French Intellectual Property Code

The list of plant species whose new varieties which are the subject of certificate applications may not be disclosed and freely exploited without special authorisation shall be laid down by regulation.

Subject to article L. 623-10, this authorisation may be granted at any time. It is acquired ipso jure at the end of a period of five months from the day on which the application for a certificate is lodged.

La liste des espèces végétales dont les obtentions faisant l’objet de demandes de certificat ne peuvent être divulguées et exploitées librement sans autorisation spéciale est fixée par voie réglementaire.

Sous réserve de l’article L. 623-10, cette autorisation peut être accordée à tout moment. Elle est acquise de plein droit au terme d’un délai de cinq mois à compter du jour de dépôt de la demande de certificat.
