Article L6323-9-2 of the French Labour Code

The service provider referred to in Article L. 6351-1 may entrust to a subcontractor, by contract and under its responsibility, the performance of the actions referred to in Article L. 6323-6, under conditions defined by regulation. The subcontractor must first have made the declaration provided for in article L. 6351-1 and provide proof of compliance with the conditions mentioned in 1° to 3° and 5° of article L. 6323-9-1.

When one or more of the conditions mentioned in 1° to 3° and 5° cease to be fulfilled by the subcontractor, the Caisse des dépôts et consignations, after giving formal notice to the service provider mentioned in the first paragraph of this article in accordance with the procedures laid down by regulation, will derefer the service provider.

A Conseil d’Etat decree shall specify the procedures for implementing this article.

Article L6323-9-2

Le prestataire mentionné à l’article L. 6351-1 peut confier à un sous-traitant, par contrat et sous sa responsabilité, l’exécution des actions mentionnées à l’article L. 6323-6, dans des conditions définies par voie réglementaire. Le sous-traitant doit avoir préalablement procédé à la déclaration prévue à l’article L. 6351-1 et justifier du respect des conditions mentionnées aux 1° à 3° et 5° de l’article L. 6323-9-1.

Lorsqu’une ou plusieurs des conditions mentionnées aux mêmes 1° à 3° et 5° cessent d’être remplies par le sous-traitant, la Caisse des dépôts et consignations, après avoir mis en demeure le prestataire mentionné au premier alinéa du présent article selon des modalités fixées par voie réglementaire, procède au déréférencement du prestataire.

Un décret en Conseil d’Etat précise les modalités de mise en œuvre du présent article.
