Article L642-6 of the French Commercial code

A substantial change in the objectives and means of the plan may only be decided by the court, at the request of the transferee.

The court shall rule after hearing or duly summoning the liquidator, the court-appointed administrator where one has been appointed, the auditors, the person or persons appointed by the social and economic committee and any interested person and after obtaining the opinion of the public prosecutor.

However, the amount of the transfer price as set in the judgment adopting the plan may not be modified.

Article L642-6

Une modification substantielle dans les objectifs et les moyens du plan ne peut être décidée que par le tribunal, à la demande du cessionnaire.

Le tribunal statue après avoir entendu ou dûment appelé le liquidateur, l’administrateur judiciaire lorsqu’il en a été désigné, les contrôleurs, la ou les personnes désignées par le comité social et économique et toute personne intéressée et après avoir recueilli l’avis du ministère public.

Toutefois, le montant du prix de cession tel qu’il a été fixé dans le jugement arrêtant le plan ne peut être modifié.
