Article L6434-10 of the French General Code of Local Authorities

The local authority is subrogated to the rights of the victim to obtain from the perpetrators of the offences referred to in the second paragraph of article LO 6434-8 the restitution of sums paid to the elected representative concerned. It also has a direct right of action for the same purposes, which it may exercise, if necessary by bringing a civil action, before the criminal courts.

Article L6434-10

La collectivité est subrogée aux droits de la victime pour obtenir des auteurs des infractions visées au second alinéa de l’article LO 6434-8 la restitution des sommes versées à l’élu intéressé. Elle dispose en outre, aux mêmes fins, d’une action directe qu’elle peut exercer, au besoin par voie de constitution de partie civile, devant la juridiction pénale.
