Article L645-10 of the French Commercial code

After obtaining the opinion of the public prosecutor and on the report of the judicial representative or the person chosen on the basis of the first paragraph of II of article L. 812-2 or on the basis of III of the same article, the assigned judge refers the case back to the court in order to apply the provisions of article L. 645-9 or to order the closure of the professional recovery procedure, without there being any need for liquidation. An appeal may be lodged against the closure ruling under the conditions laid down by decree in the Conseil d’Etat.

The court’s decision is final.

Article L645-10

Après avoir recueilli l’avis du ministère public et sur le rapport du mandataire judiciaire ou de la personne choisie sur le fondement du premier alinéa du II de l’article L. 812-2 ou sur le fondement du III de ce même article, le juge commis renvoie l’affaire devant le tribunal aux fins d’application des dispositions de l’article L. 645-9 ou aux fins de voir prononcer la clôture de la procédure de rétablissement professionnel, sans qu’il y ait lieu à liquidation. Le jugement de clôture peut faire l’objet d’un recours dans les conditions fixées par décret en Conseil d’Etat.
