When over-indebtedness proceedings are initiated before a commission at the request of a sole trader with limited liability, the latter shall indicate, when filing the case, whether proceedings instituted by Titles II to IV of Book VI of the Commercial Code are open for his benefit and with which court.

When proceedings instituted by the Titres II to IV of Book VI of the Commercial Code is opened for the benefit of the debtor after the file has been filed and before, as the case may be, the approval of the conventional recovery plan provided for in Article L. 732-1, until the decision imposing the measures provided for in Articles L. 733-1, L. 733-4, L. 733-7 and L. 741-1, until the judgment pronouncing a personal recovery without judicial liquidation or until the judgment opening a personal recovery procedure with judicial liquidation, the debtor informs the overindebtedness commission and indicates with which court this procedure has been opened.

Lorsqu’une procédure de surendettement est engagée devant une commission à la demande d’un entrepreneur individuel à responsabilité limitée, celui-ci indique, lors du dépôt du dossier, si une procédure instituée par les titres II à IV du livre VI du code de commerce est ouverte à son bénéfice et auprès de quelle juridiction.

Lorsqu’une procédure instituée par les titres II à IV du livre VI du code de commerce est ouverte au bénéfice du débiteur après le dépôt du dossier et avant, selon les cas, l’approbation du plan conventionnel de redressement prévu à l’article L. 732-1, jusqu’à la décision imposant les mesures prévues aux articles L. 733-1, L. 733-4, L. 733-7 et L. 741-1, jusqu’au jugement prononçant un redressement personnel sans liquidation judiciaire ou jusqu’au jugement d’ouverture d’une procédure de rétablissement personnel avec liquidation judiciaire, le débiteur en informe la commission de surendettement et indique auprès de quelle juridiction cette procédure a été ouverte.
