Where the length of service exceeds fifteen years, an arbitration commission is appointed to determine the compensation due.
This commission is made up equally of arbitrators appointed by the employers’ and employees’ professional organisations. It is chaired by an active or retired civil servant or magistrate.
If the parties or one of them fails to appoint arbitrators, they shall be appointed by the president of the judicial court, under conditions determined by regulation.
If the arbitrators appointed by the parties are unable to agree on the Chairman of the Arbitration Commission, he shall be appointed by the President of the Tribunal Judiciaire at the request of the earliest party.
In the event of serious misconduct or repeated misconduct, the compensation may be reduced by a proportion to be determined by the committee, or even withdrawn.
The decision of the arbitration committee is binding and cannot be appealed.
