A professional journalist is any person whose main, regular and remunerated activity is the exercise of his profession in one or more press companies, daily and periodical publications or press agencies and who derives the main part of his resources from this. The following are treated in the same way as professional journalists: direct editorial staff, copywriters/translators, stenographers/editors, copywriters/revisers, reporters/drawers, reporters/photographers, excluding advertising agents and all those who, in any capacity whatsoever, provide only occasional assistance.
Journalists working for one or more electronic media companies have the status of professional journalist.
The collaboration between a press company and a professional journalist covers all the media of the press title as defined in the first paragraph of article L. 132-35 of the Intellectual Property Code, unless otherwise stipulated in the employment contract or in any other ad hoc collaboration agreement.
A copy of the code of ethics provided for inarticle 2 bis of the law of 29 July 1881 on the freedom of the press is given to all journalists when they are hired and to all journalists already employed in a press company, daily or periodical publication, press agency, electronic or audiovisual communication company, within three months of the adoption of the code by this company or agency.
Professional journalists have a professional identity card, the conditions of issue, period of validity, conditions and forms in which it may be cancelled being determined by decree in the Conseil d’Etat. Former professional journalists may be issued with an honorary professional journalist’s identity card under the conditions determined by the same decree.
In the undertakings referred to in Articles L. 7111-3 and L. 7111-5, where a specific electoral college is created for professional journalists and persons treated as such, the trade union organisation that satisfies the criteria of Article L. 2121-1 and that received at least 10% of the votes cast in the first round of the most recent elections of full members of the social and economic committee in this college…
In the branches that cover the activities of press companies, daily or periodical publications and press agencies, as well as the activities of companies communicating to the public by electronic means or audiovisual communication, the trade union organisations that meet the conditions of article L. 2122-5 in the journalists’ electoral colleges are representative with regard to the staff mentioned in article L. 7111-1.
