Article L7313-12 of the French Labour Code

Unless a contractual clause is more favourable to the traveller, sales representative or sales representative, the right to commission is assessed on the basis of the normal duration established by custom.

A longer period may be used to take account of administrative, technical, commercial or financial constraints specific to the customer. This period may not exceed three years from the date on which the employment contract ended.

Sauf clause contractuelle plus favorable au voyageur, représentant ou placier, le droit à commissions est apprécié en fonction de la durée normale consacrée par les usages.

Une durée plus longue est retenue pour tenir compte des sujétions administratives, techniques, commerciales ou financières propres à la clientèle. Cette durée ne peut excéder trois ans à compter de la date à laquelle le contrat de travail a pris fin.
