Article L7313-13 of the French Labour Code

In the event of termination of an open-ended employment contract by the employer, in the absence of serious misconduct, the traveller, sales representative or sales representative is entitled to compensation for his personal share of the number and value of customers brought in, created or developed by him.

The amount of this customer compensation takes into account any special remuneration granted during the term of the contract for the same purpose as well as any decrease in the pre-existing customer base attributable to the employee.

These provisions also apply in the event of termination of the employment contract as a result of accident or illness leading to total permanent incapacity to work on the part of the employee.

En cas de rupture du contrat de travail à durée indéterminée par l’employeur, en l’absence de faute grave, le voyageur, représentant ou placier a droit à une indemnité pour la part qui lui revient personnellement dans l’importance en nombre et en valeur de la clientèle apportée, créée ou développée par lui.

Le montant de cette indemnité de clientèle tient compte des rémunérations spéciales accordées en cours de contrat pour le même objet ainsi que des diminutions constatées dans la clientèle préexistante et imputables au salarié.

Ces dispositions s’appliquent également en cas de rupture du contrat de travail par suite d’accident ou de maladie entraînant une incapacité permanente totale de travail du salarié.
