Article L7221-2 of the French Labour Code

The only provisions applicable to the employee defined in Article L. 7221-1 are those relating to :

1° Moral harassment, as provided for in articles L. 1152-1 et seq., sexual harassment, as provided for in articles L. 1153-1 et seq. as well as legal action by trade union organisations arising from harassment pursuant to article L. 1154-2 ;

2° May Day, as provided for in Articles L. 3133-4 to L. 3133-6;

3° Paid leave, as provided for in articles L. 3141-1 to L. 3141-33, subject to adaptation by decree in the Conseil d’Etat ;

4° Leave for family events, for family solidarity and for close assistance, as provided for in articles L. 3142-1 to L. 3142-27;

5° Medical surveillance as defined in Title II of Book VI of Part Four.

Article L7221-2

Sont seules applicables au salarié défini à l’article L. 7221-1 les dispositions relatives :

1° Au harcèlement moral, prévues aux articles L. 1152-1 et suivants, au harcèlement sexuel, prévues aux articles L. 1153-1 et suivants ainsi qu’à l’exercice en justice par les organisations syndicales des actions qui naissent du harcèlement en application de l’article L. 1154-2 ;

2° A la journée du 1er mai, prévues par les articles L. 3133-4 à L. 3133-6 ;

3° Aux congés payés, prévues aux articles L. 3141-1 à L. 3141-33, sous réserve d’adaptation par décret en Conseil d’Etat ;

4° Aux congés pour événements familiaux, de solidarité familiale et de proche aidant, prévus aux articles L. 3142-1 à L. 3142-27 ;

5° A la surveillance médicale définie au titre II du livre VI de la quatrième partie.
